Miley Cyrus Fires Back At ‘Flowers’ Copyright Lawsuit With Claims Of A ‘Fatal Flaw’
Miley Cyrus has hit back at a lawsuit claiming her hit "Flowers" copied Bruno Mars’ “When I Was Your Man,” calling it flawed because Mars and his co-writers chose not to sue.
The lawsuit, filed by Tempo Music Investments in September, alleges Cyrus stole key elements from the song.
Tempo owns a portion of the rights after buying out one of his co-writers.
“Plaintiff unambiguously [says] that it obtained its claimed rights in the ‘When I Was Your Man’ copyright from only one of that musical composition’s four co-authors. That is a fatal and incurable defect in plaintiff’s claim,” write Cyrus’ attorneys.
Under federal copyright law, her lawyers say such limited rights don’t give him “standing” to sue – a crucial requirement for any lawsuit in the U.S. legal system.
